How Many Jobs Will The Jobs Bill Create?

Even supporters say that it is a modest measure, so how many jobs will the jobs bill actually create? A rare bit of bi-partisanship helped move the bill forward in the Senate, but can that spirit be harnessed for other measures? Tea Party activists are calling newly elected Massachusetts Republican Scott Brown “Benedict Brown” for supporting this measure. We’ll speak with Naftali Bendavid, Congress and politics reporter for the Wall Street Journal.

Restitution For Victims Of Child Porn

Federal judges are now being asked to consider whether someone convicted of possessing child porn should pay restitution to the children in those images. “Amy,” as she’s known in court papers, is now 20; but when she was 8 or 9 her uncle took pictures of her that are among the most circulated child porn images. She’s using the Crime Victims Rights Act of 2004 to win millions of dollars in court-ordered damages from people who use those abusive images of her. We speak with Amy’s attorney, James Marsh, and Jonathan Shapiro, who is defending a man who has been ordered to pay restitution to her.

Shadow Of Saddam

As Iraq prepares for parliamentary elections next month, the legacy of Saddam Hussein continues to cast a long shadow. Hundreds of candidates have been barred from running for office because of alleged links to the former dictator’s now outlawed Baath party. As the BBC’s Gabriel Gatehouse reports that has thrown a bit of chaos into the pre-election mix.

Cyber-spying In High School?

Students in a school district in Pennsylvania are taping up the webcams in their school-issued laptops, after one student claimed school officials were spying on him at home. Bill Bender of the Philadelphia Daily News joins us; we’ll also speak to Larry Magid of ConnectSafely.Org.

    I am trying to provide some information on the LM case.
    My 10 grader is a student of the district. His teacher has told him that the computer that was tracked, the one that is in the lawsuit, was a loaner computer. This means that the computer is not supposed to leave campus. Apparently, when this computer went off campus, the school activated the tracking device which involved taking a picture when the computer was opened.
    The school indeed had never told the students or the parents of this devise and they should.
    On the other hand, if the devise was indeed activated because the computer was deem lost. The school was acting to try to recover a lost item. (Again they should have let the parents and students know about the devise and this procedure, which they did not.) The school now says that the devise has only be activated 42 times and every time, it is for recovery of lost computers.
    Let’s wait for more facts.

    In regard to Victims of child pornograhpy, if it is possible to tell if someone is viewing the pics why isn’t it possible to remove them? I understand that there are countless places these pics could be. but if there is a way to ‘tag’ them so you can tell they are being viewed, why doesn’t the tagging remove them or prevent them from being opened?

    Re the 1943 Oscars: I’m surprised this got past Ty Burr, but that year’s nominee HEAVEN CAN WAIT was not the film remade by Warren Beatty in 1978. (That was 1941′s Here Comes Mr. Jordan). The 1943 HEAVEN CAN WAIT, directed by Ernst Lubitsch, was the odd man out in that year’s list of nominees: the story of the life of a roue, told in flashback as he is interviewed after his death by the devil, couldn’t be more different than all those movies about the war.

    In regards to the victims of child porn,obviously the man who is has been ordered to pay restitution has the “deep pockets” in the group. If the uncle who took the pictures had money she would be going after him. I can’t even begin to imagine the horror that this poor girl went through at the hands of a family member but to single out this man doesn’t seem fair.

    Concerning the Amy lawsuit: This $3.6 million so-called “cap” of damage awards this lawyer was talking about…where that first defendant has to go out and sue other defendants or he pays the whole thing…does that have any legal precedent? I’ve never heard of such a thing.

      Attorney James Marsh has this reply, about the type of liability that abusers face:
      “Joint and several liability means each party is equally liable for 100% of the damage. It also means that each party can seek something called “contribution” from the other parties to even out the liability. This happens all the time in personal injury and commercial litigation cases. If A sues B, B can sue C if C had any role in contributing to A’s injury. Think of an auto accident. If A sues the car manufacturer, the car manufacturer can sue the tire company if it thinks the tire company had a role in the accident. This is an ancient principle in the law going back hundreds of years.”

    With regard to restitution claims for victims of child pornography … humans like Arthur Staples are the ones who have made a market for child pornography, thus putting children at risk of being made victims. Sue them, sue them for everything possible, in order to help shut down the market. If the record companies can sue individuals for millions for illegally possessing copyrighted recordings, why can’t a child hold a “copyright” over her own images, and hold the possessors to the same level of responsibility?

    If the threat of being sued for huge damages lessens the temptation by pedophiles to download child porn images, or delete the images the have, then it is a good thing. And to the folks who think that they can view this garbage but are not pedophiles? Don’t fool yourselves. If you view sexual images of children, get treatment!

    The whole thing reminds me a past crime in which a crowd watched a rape, cheering on the rapist. Supporting the demand for child porn is the same as cheering on the pervert who creates it.

    “What are the ‘damages’ to the victim?” — how would you like the whole world being able view humiliating and hurtful photos of YOU, or of your child? Would you feel damaged, harmed?
